NEWS OF THE FEDERAL LEGISLATION

There are approved the Rules of submission of information by a foreign investor about making deals with stocks consisting authorized capitals of associations having strategic importance for defense of the country

The Decree of the Government of the Russian Federation N 795 of October 27, 2008 (document is in Russian) approves the Rules for submission of information by a foreign investor or a group of persons where a foreign investor is included about information on making deals with stocks (shares) consisting authorized capitals of economic associations having strategic importance for defense of the country and safety of the state .


These Rules are established for execution of article 14 of the Federal Act "On the procedure for foreign investments in economic associations having strategic importance for defense of the country and safety of the state" (document is in Russian).

In accordance with the Rules, information about acquisition of 5 and more percent of stocks (shares) consisting authorized capitals of economic associations having strategic importance shall be submitted by a foreign investor or a group of persons to authorized body by means of directions of notification made in optional form during 45 days since the moment of making deal, and necessary documents shall be annexed to the notification.

The Decree of the Government of the Russian Federation N 792 of October 27, 2008 (document is in Russian) approves on a permanent basis the rates of import customs duty in respect of cuttings of grape (codes of the TN VED 0602 10 100 0 and   0602 20 100 0) in the size of 5 percent of customs cost since October 15, 2008.

The Decree of the Government of the Russian Federation N 793 of October 27, 2008 (document is in Russian) makes amendments to the structure of classification codes of the Foreign Trade Activity Nomenclature of the Russian Federation (document is in Russian) in respect of beverages containing alcohol, as well as terminals of electronic payments by means credit or debit cards. There are approved the rates of import customs duties on fermented beverages and non-alcoholic beverages (subpositions 2206 00 of the TN VED of Russia), as well as cash machines (code 8470 50 000 0 of the TN VED of Russia). The Decree shall put into effect upon two months after the day of its official publication.

The amendments are made to the procedure for making up and submission of financial statements by credit institutions

The Directions of the Bank of Russia N 2088-U of October 8, 2008 (document is in Russian) makes amendments to the Directions of the Bank of Russia N 1363-U "On making up and submission of financial statements by credit institutions" of December 25, 2003 (document is in Russian), which determine that now credit institutions shall make their financial statements so with use of the database forming on a basis of primary documents.

Besides, there is established that in the case of making consolidated financial statements for the period begging from January,1 and finishing on December, 31, financial statements of parent (head) credit institutions shall not be confirmed by an auditors organization.

  The Direction shall putt into effect upon 10 days after the day of its official publication in the "News Bulletin of Russia".
