In accordance with amendments, in addition
to consumer's cooperatives this
Federal Act shall not by applied associations of dwelling
owners, gardening and country non-commercial associations of
citizens.
There is established the procedure for transfer of escheat as dwelling premises to ownership of municipal formations and cities of federal importance
In purposes
of regulation and simplification of the procedure for drawing
up and transfer of escheated dwelling premises to ownership
of municipal formation and cities of federal importance, and
for avoidance of problems arisen from transfer of ownership
from one legal position to another,
the Federal Act N 281-FZ of November 29, 2007 (document
is in Russian) makes amendments to
the part three of the Civil Code of the Russian Federation
determining the procedure for transfer of dwelling premises
located in the territory of the Russian Federation in order
of inheritance to ownership of municipal formations and cities
of federal importance Moscow and Saint-Petersburg, with inclusion
of aforesaid dwelling premises to according housing fund of
social using.
The Act determines that mutual insurance is insurance of property
interests of association on mutual base by means of amalgamation
in association of mutual insurance of necessary for this funds.
The amendments are made to the Federal Act "On export control"
The Federal Act N 283-FZ of November 29, 2007 (document
is in Russian) makes amendments to
the Federal Act N 183-FZ "On export control" of July
18, 1999. In particular
article 1 of the Act is added with new notion "production
being specially dangerous in the part of preparation and (or)
performance of acts of terrorism". There is specified determination
of such notions as "export control" and "Russian
participants of foreign economical activity". The amendments
are made to
article 19 of the Act determining the procedure for licensing
of foreign economic operations with goods and technologies under
control. In particular, there is established, that foreign economic
operations providing transfer of goods and technologies under
control (including the rights on them) to foreign persons, import
of certain categories of goods and technologies under control
to the customs territory of the Russian Federation are subjects
for licensing in the cases if it is necessary for safety of
the state or performance of international obligations of the
Russian Federation. Nomenclature of goods and technologies under
control, import of which to the customs territory of the Russian
Federation is subject for licensing shall be established by
the Government of the Russian Federation. The Act shall be applied
not only in respect of goods and technologies under control,
but to transfer and use of rights on them. The Act shall come
into effect from January 1, 2008.
There has been changed to procedure for application of tax rates on the tax on profit of organizations for agriculture producers not transferred to the united agriculture tax
Besides, there is extended the list of incomes exempted
from taxation by the tax on incomes of natural persons - to
such incomes there are referred sums of payments for acquisition
and (or) construction of dwelling premises granted for funds
of the federal budget, budgets of RF subjects and local budgets.
At that, there is established that property tax deduction on
the tax on incomes of natural persons shall not be applied in
the cases when payment of expenditures for construction an acquisition
of dwelling premises is made for funds of employees and other
persons, funds of maternal (family) capital, funds directed
to maintenance of implementation of additional measures of state
support of families having children, for funds of payment granted
from the federal budget, budgets of RF subjects and local budgets,
as well as in the cases when deals of purchase and sale is made
between natural persons being interdependent.
There are changed the rates of collections for use of objects of water biological resources
The Federal Act N 285-FZ of November 29, 2007 (document
is in Russian) makes amendments to
chapter 25_1 of the RF Tax Code (document is in Russian),
and in accordance with them, as objects of imposing collections
for use of objects of water biological resources are considered
objects of water biological resources, which withdrawing from
their habitat is provided on the basis of the permit (not license)
for catch of water biological resources.
Besides, there
are established new rates of collections for use of objects
of water biological resources, and corresponding amendments
are made to
clauses 4 and
5 of article 333_3 of the RF Tax Code. These amendments
shall come into effect from January 1, 2008, but not earlier
than upon expiration of one months from the day of official
publication of this Federal Act.
The Federal Act N 277-FZ of November 29, 2007 (document
is in Russian) ratified the Agreement on uniform procedure for
export control of the states - members of the European economical
association, assigned in Moscow as on October 28,
2003.
