Amendments to the Criminal Procedure Code, in relation to property damage
Amendments
to
the Federal law N 144-FZ issued on July 1, 2010(document is in Russian), established that only the court, including the time of
pretrial proceedings, is empowered to make decisions on compensation
for property damages in criminal proceedings.
Also, according
to the amendments, no later than one month since the date of
receiving a claim for property damage a judge determines its
size and makes a decision about the compensation of the damage.
Previously the law allowed an investigator to perform the abovementioned
actions.
