NEWS OF THE FEDERAL LEGISLATION

The amendments are made to the Customs Code of the Russian Federation

By the Federal Act N 231-FZ of October 13, 2009 (document is in Russian), the amendments are made to article 69 and 119 of the Customs Code of the Russian Federation (document is in Russian), pursuant to which it is established that the Government of the Russian Federation has the right to determine cross-points through the State boarder of the Russian Federation for withdrawal of certain kinds of goods from the customs territory of the Russian Federation.

The Federal Act shall putt into effect upon expiration of one month since the day of its official publication.
 
By the Federal Act N 232-FZ of October 13, 2009 (document is in Russian), the amendments are made to articles 138 and 325 of the Customs Code of the Russian Federation, which are directed to improvement of the procedure of periodical temporary declaring. In particular, it is established that the rates of customs duties shall be applied as on the day of actual exportation of goods from the customs territory of the Russian Federation. As the day of actual exportation of goods, it is considered the day of making marks permitting withdrawal of the goods on transportation (carrying) or other documents by customs body located in the place of withdrawal of the goods from the customs territory of the Russian Federation.

  So, it is established that if upon expiration of eight months, and in respect of Russian goods liable with export customs duties or to which bans and restrictions of an economical character are applied - upon expiration of six months, Russian goods shall not be exported from the RF customs territory, the customs declaration, by which these goods were applied for export, shall be considered as not submitted.

The Federal Act shall putt into effect upon expiration of one month since the day of its official publication.

There are decreased the sizes of interest rates on deposit operations of the Bank of Russia, overnight credits and loan credits

By the Directions of the Bank of Russia N 2300-U, 2301-U, 2302-U, 2303-U of September 29, 2009 (documents are in Russian), there are established the following interest rates on operations of the Bank of Russia:

- the interest rate on the overnight credit of the Bank of Russia is established in the size of 10 per cent per annum;

- on deposit operations of the Bank of Russia carrying out in accordance with the Statute of the Bank of Russia N 203-P "On the Procedure of Performance by the RF Central Bank of Deposit Operations with Credit Institutions in Currency of the Russian Federation" of November 5, 2002 (document is in Russian) on the terms "tom-next", "spot-next", "at call", - 4,75 per cent per annum, and on term "one week", "spot-week" - 5,25 per cent per annum;

- on loan credits of the Bank of Russia granting in accordance with the Statute of the Bank of Russia N 236-P "On the Procedure for Granting Credits Secured by Mortgage (Block) by the Bank of Russia to Credit Institutions" of August 4, 2003 (document is in Russian) for the period of 1, 7 and 30 calendar days in the size of 9 per cent per annum;
 
- on credits secured with assets or guarantees granting in accordance with the Statute of the Bank of Russia N 312-P "On the procedure for granting credit secured which assets or guarantees by the Bank of Russia" of November 12, 2007 (document is in Russian) for the period up to 90 calendar days - 9 per cent per annum; for the period from 91 up to 180 calendar days - 9,5 per cent per annum; for the period from 181 up to 365 calendar days - 10 per cent per annum.
