The new Federal Act "On the Enforcement Proceedings" has come into force
On February,
1st, 2008 the new
Federal Act from October, 2nd, 2007 N 229-FZ "On the Enforcement
Proceedings" has come into force. The Act has not changed
the concept of the current legislation of the Russian Federation
about executive manufacture, however it has entered a number
of essential short changes in legal regulation of the given
sphere. The important innovations
of theAct are the norms, the references of collecting devoted
to questions on the securities adjusting terms of fulfilment
of executive actions, concerning excitation of executive manufacture,
the reference of collecting on property of the debtor, an estimation
and realization of the arrested property of the debtor, distribution
of the collected sum of money. Olso there is entered the new
chapter regulating questions of realization of property of the
debtor at the tenders. With
a view of strengthening the control over accepted judicial police
officers-executors decisions on executive manufacture by the
Law provide an opportunity of the appeal of actions of judicial
police officers-executors (alongside with judicial order) to
the main judicial police officer of the Russian Federation,
the main judicial police officer of the subject of the Russian
Federation and the senior judicial police officer.
Also
the Federal Act from October, 2nd, 2007 N 225-FZ, brings
respective alterations in a number of acts of the Russian Federation.
There are approved the Rates of a rent for using the ground areas which privatization is not supposed according to the legislation of the RF and also which are transferred to the organizations of power industrial complex under contracts of rent

the RF Government Decreen from January, 25th, 2008 N 30

the Rates of a rent for using the ground areas which privatization
is not supposed according to the legislation of the Russian
Federation and also which are transferred to the organizations
of power industrial complex under contracts of rent.
Also it is established, at definition
of the size of annual rent payments for using the ground areas
which privatization according to the legislation of the Russian
Federation is not supposed and also which are transferred the
organizations of power industrial complex under contracts of
rent, rates of a rent are a subject to indexation in view of
a rate of inflation stipulated by the federal act on the federal
budget for the next fiscal year and the scheduled period, and
in case of the size of annual rent payment for using the corresponding
ground area exceeds 50 percent of the sum calculated proceeding
from the Russian Federation established according to
the Tax Code of the Russian Federation of the rate of the
ground tax, the rate of a rent changes Federal agency on management
of federal property on the basis of the reference of the corresponding
organization of power industrial complex.
There are made changes to Regulations about carrying out of competition on selection of applications for creation of special economic zones and in Rules of registration and application for creation of a special economic zone
Besides it is defined what data the application for creation
of a port special economic zone, and as should contain the list
of documents which are in addition applied on the application,
except for what are already certain in
item 13 of Rules.
There are made changes to Position on book keeping "the Account of actives and obligations which cost is expressed in a foreign currency" Position on book keeping 3/2006
The basic amendments concern
the order of recalculation of the cost of actives expressed
in a foreign currency and obligations in roubles. In particular,
it is established, that at insignificant change of an official
rate of a foreign currency for the rouble, established by the
Central bank of the Russian Federation, recalculation in the
roubles, connected with fulfilment of the big number of homogeneous
operations in such foreign currency, it can be made at the average
rate estimated for month or shorter period.
