There has been adopted the Federal Act "On navigation activity"
The Federal Act N 22-FZ ""On navigation activity"
of February 14, 2009 (document is in Russian) establishes
the legal basements for navigational activity and is directed
to creation of conditions and satisfaction of needs in the sphere
of navigation activity. Effect of
the Act is applied to relations arising in accordance with
navigation activity and rendering services in the navigation
activity sphere including the purposes of defense and safety
of the Russian Federation.
The Federal Act determines entities of legal relations in
the sphere of navigation activity, the ownership rights for
navigation facilities and the national culture objects. There
are established the authorities of the Russian Federation President
and the Russian Federation Government in the sphere of navigation
activity, bodies of state power of the Russian Federation subjects
and bodies of local self-government in this sphere, as well
as the rights of natural persons and legal entities at performance
of navigation activity. In particular, there is specified that
the Russian Federation Government determines the specific features
for navigation activity during the mobilization period, the
martial law period and wartime. There is established that financial
secure of navigation activity shall be provided for the funds
of assignations from the federal budget, the budgets of the
Russian Federation subjects, local budgets, own and attracted
funds of legal entities and natural persons, and for other resources
pursuant to the Russian Federation legislation.
From January
1, 2011, the norm shall putt into effect, pursuant to which
in the purposes of defense and safety of the Russian Federation,
increasing of efficient of administration with transport vehicles
traffic, safety level of transportation of passengers, special
and dangerous cargos, making geodetic and cadastre works, transport,
technical vehicles and systems (including armament, military
and special technique), list of which shall be determined by
the federal executive authority, executive bodies of the Russian
Federation and local self-government bodies in accordance with
their authorities, shall be subjects for equipping with navigation
facilities, functioning of which shall be granted by the Russian
navigation systems.
