NEWS OF THE FEDERAL LEGISLATION


The Federal Act "On order of formation and using of target capital of non-commercial institutions" is adopted

      The Federal Act N 275-FZ of December 30, 2006 (document is in Russian) regulates relations arising on collection of monetary funds for formation of target capital of non-commercial institutions, formation and breaking up of target capital of non-commercial institutions, trust management with property consisting target capital of non-commercial institutions, using of incomes received from trust management with property consisting target capital of non-commercial institutions and intended for financing of charter activity of non-commercial institutions. So, it determine specific features of legal position of non-commercial institutions forming target capital. It should be taken into consideration, that non-commercial institutions - owners of target capital, except specialized institutions have the right to provide only that kinds of paid activity which were determined by the Government of the Russian Federation.
      
     In accordance with adoption of the Federal Act "On order of formation and using of target capital of non-commercial institutions", the Federal Act N 276-FZ of December 30, 2006 (document is in Russian) shall putt into effect since the moment of its publication, which makes amendments to the Federal Acts "On charitable activity and charitable institutions", " On Non-Commercial Organizations" (document is in Russian), second part of the Civil Code of the Russian Federation, second part of the Tax Code of the Russian Federation (document is in Russian).

Licensing of auditors activity and activity concerning to construction of buildings and construction shall be cancelled as on July 1, 2007

     According amendments are maid by the Federal Act N 252-FZ of December 29, 2006 (document is in Russian) to the Federal Act N 128-FZ "On licensing of certain kinds of activity" of August 8, 2001 (document is in Russian).

The Agreement between the RF Government and the Government of the French Republic on cooperation in destruction of reserves of chemical weapons in the Russian Federation has been ratified

      The Federal Act N 279-FZ of December 30, 2006 (document is in Russian) has ratified the Agreement between the Government of the Russian Federation and the Government of the French Republic on cooperation in destruction of reserves of chemical weapons in the Russian Federation (document is in Russian) assigned in Moscow city as on February 14, 2006.

The amendments are maid to the Decree of the RF Government "On labeling of alcohol products imported into the customs territory of the Russian Federation before 31.03.06 inclusive and labeled by means of excise-duty labels valid until 31.12.06 inclusive"

      The Decree of the Government of the Russian Federation N 809 of December 28, 2006 (document is in Russian) makes amendments to the Decree of the Government of the Russian Federation N 398 of June 29, 2006 (document is in Russian), and in accordance with them it is established that, in particular excise-duty labels have been acquired by organizations at the place of their state registration in customs bodies till December 29, 2006 inclusive.

The amendments are maid to the Order of the FSFM of Russia "On delimitation of powers on state registration of issues (additional issues) of emission securities between the Federal service for financial markets and its territorial bodies"

      The Order of the Federal Service for Financial Markets of Russia N 06-131/pz-n of November 21, 2006 (document is in Russian) makes amendments to the Order of the Federal Service for Financial Markets of Russia N 05-15/pz-n "On delimitation of powers on state registration of issues (additional issues) of emission securities between the Federal service for financial markets and its territorial bodies" of April 20, 2005 (document is in Russian), in accordance which there shall be increased general value on nominal cost of issuer's  emission securities allocated by means of closed subscription till 200 mln.rubles. So, size of authorized capital of issuer's emission securities as on moment of approval of the decision on issue (additional issue) of emission securities shall not be less than 1 bn.rubles.
